We traded in wife's car (her name only) and bought a new vehicle (only my name). Went to register vehicle and was told because the car we traded was in her name and new one is only in my name, we have pay tax on the full price of the vehicle rather the difference of trade. At no point did the dealership bring this up. We could've made a quick donation to me or took the hit on the % points by putting wife on the new car but none of these options were given to us. Are we screwed? Is the dealership liable in any way? Can anything be done retroactively?

Why would a dealership in one state be expected to not only know about the tax implications of registration in another state but be held liable for it? Seems like the buyer’s responsibility to know these things or accept the consequences otherwise.

Tax credit if (in your situation) wifes name is on new car (even if you are also on car), tax credit is on an individual basis

Wife's name isn't on new car. That's why we are facing the penalty. Is there a way the dealership can retroactively add her and we take the higher apr?

Sounds like due diligence wasn't completed before any signatures were signed.

So your wife’s credit sucks?

It didn't. 2nd daughter was born with many medical issues. Insurance had her wrong birthdate so bills were coming in with outrageous amounts so in the process of figuring out what was going on, her credit took the hit.

Don't know if it will help, but you might try to play the community property card. Regardless of the name on the title, you may legally both own it (don't know your fact set).

Call the dealership, explain the situation, and see if they can reissue the paperwork to put the new car in wife’s name. Never hurts to ask.
