Any bankruptcy attorneys here?

Mine is impossible to reach and I have a question. I filed chapter 13 and am now in month 55 of 60 of the plan. I’m getting divorced and attorney filed a modification to the plan to allow for support of second household. Been waiting 2 months on confirmation hearing in the meantime the trustee has collected about 8k over my current due on the plan. The remaining 5 months are going to be way less than that like 5k. Are they going to call the plan good and give me back 3k? Or just call the plan good? Or?

My plan did not pay 100% of the debt but all disposable income has been collected plus 8k.

Call the clerk of court for the bankruptcy court, give them your case number, and ask for the status of the request/motion for modification. They should be able to see if there is a hearing date set or other sign of activity related to it.

Do they have a secretary or paralegal who might be able to answer your questions?

Don't be telling people on a message board to file complaints against their attorneys. Do you know how fricking retarded most people are?

No kidding. "impossible to reach" = I thought about calling every day for three months, but when I finally called after 3 pm on a Friday before a holiday, he/she didn't personally answer the phone! Or, I called 79 times, but I don't like to leave voice mails, so I never left a message...and I don't like giving out my new cell number, so I blocked my number before calling.

People LOVE to complain about non-responsiveness, but they're often too damn lazy to read the documents in their possession.
