So now the schhol decides if Fulton plays?
From everything I have read so far, the school must now sign a waiver for Fulton to play that would be similar to the injunctions that Elliot was using to play last year.

Any reason the University would choose to not sign this if it gave him immediate eligibility? Does this waiver have to be accepted by another party for Fulton to play or is it as simple as LSU signing the waiver allowing Fulton to play while the case is on going?

I imagine the school would be completely behind one of their own students when the rule is completely bull shite.

My understanding (could be wrong) is that LSU has to REQUEST the waiver from...wait for it...the NCAA.

The question I have is whether or not there has to be some sort of lawsuit first...and whether or not LSU has to be a party to that lawsuit.

LSU (like all schools/athletic departments) is a BUNCH of moving pieces. Right now they are moving in completely independently directions. Look at Alabama and they're completely synchronized and that's why they have so much success. There's no infighting or politics or egos. There's just the whole entity moving in the same direction with the same goal.

Let’s say they received the waiver and then played Fulton. Then the courts ruled against Fulton would LSU have to then forfeit all the games he played in because they played an ineligible player?

Think before you post, in your scenario the answer would be a resounding YES!!!! You can't put one players needs in front of the teams needs. In your scenario Fulton's situation can still be found not in his favor and if that is the case, what are the consequences for LSU if they decided to play him despite having a resolution? The consequences would be to forfeit all games in which Fulton played in prior to the final outcome. That price is too steep and not fair to the other players if Fulton's case isn't resolved to where he is eligible to play!!!

No the waiver makes him eligible for the time being. If the appeal fails, the time he played under the waiver, would be racked on the end up his suspension.
