If Insurrection Act is invoked, just what are the ramifications?

How will that affect our daily lives? What could/would be the outcome? What is the purpose of invoking it? What would have to happen for it to be lifted? Lots of questions...

None because it won't be implemented. If Trump were to actually invoke it, he would be removed from office almost immediately.

Don't waste your brain cells on this. Enough people already have.

I'm not. Had never heard of the Insurrection Act until it was mentioned in a thread here a few weeks ago. Just curious about the ramifications. Martial law? I kind of understand that, but the Insurrection Act? Lots of questions about it.

Not if the people that could remove him were the target of the military because of being involved in the coup

People need to make sure they have food in the pantry, gas in the car, and cash on hand. If you live in a rural area you may not even notice too much of a disruption, but if I lived in a large city I would be leaving now.

Exactly. Pence has his proverbial finger on the 25th amendment button waiting for Trump to be so foolish.

If invoking it automatically triggers the 25th, why even have it in the first place?

The Insurrection Act of 1807 is a United States federal law that empowers the President of the United States to deploy U.S. military and federalized National Guard troops within the United States in particular circumstances, such as to suppress civil disorder, insurrection or rebellion.

quote:

The act provides a "statutory exception" to the Posse Comitatus Act of 1878, which limits the use of military personnel under federal command for law enforcement purposes within the United States

quote:

Before invoking the powers under the Act, 10 U.S.C. § 254 requires the President to first publish a proclamation ordering the insurgents to disperse.

There is no insurrection for the President to quell. If the attack upon the capital building had persisted last week, President Trump could have invoked it. It would not have applied nationally unless the insurgency spread beyond DC.

Not familiar with many of the players and who knows if it's signed or not, I was just asking a logical question:

If invoking the Insurrection Act automatically triggers removal via the 25th, why even have Insurrection Act?

I think it only automatically triggers the 25th in the case of Trump in the last days of his presidency trying to cling to power.

Well, this assumes his motives are illegitimate.

Trump has no legal cover here, nor does he really care about the law. The only question is whether he has sufficient sway over the “deep state” (I include the military in that) to make his auto-coup happen. I don’t think he does, and if he tries, he’ll just end up proving it.

I really don't think his motives matter at this point. If he invokes the Insurrection act for any reason, they will take him out.

Your logic is correct, and it wouldn’t. I think the reasoning is that Pence is poised to invoke the 25th, and would do so if the President tried something crazy.
