Has anyone heard anything new on the USC/Reggie Bush case???

There’s no question there’s lack of institutional control and USC doesn’t appear to be cooperating. I’m just wondering if anyone’s seen any new articles on the NCAA investigation lately…

All's quiet. My guess is that the NCAA wants it all to go away. Unless they are actually building evidence against USC to drop the hammer on them. In that case, let them take their time.

Now that the vast discovery powers of a duly empaneled court are being brought to bear, some resolution might be imminent.

With the NCAA, most doubt it. Any depos will likely lead to either withdrawal or a settlement with sealed documents and confidentiality.

Well, the parties can't unilaterally decide to seal the deposition transcript. They would have to move the court to do so. Typically, judges are loathe to seal depositions without fairly compelling reasons for doing so.

Once the information is the deposition record, it will be very, very difficult to limits its dissemination.

My understanding is that this is true if it goes to court. My understanding is depos are not under the auspices of the court, until it goes to court, so the partiies can agree to keep them private as part of a settlement with one party (lake in this case) not pursuing court. In the vast majority of cases, discovery depos are done by private parties with no court involvement whatsoever. I have been deposed handful of times as an expert witness and twice, when there was a settlement, they were sealed as part of the settlement.

Regardless of any of this, won't there still be actions taken by the NCAA against USC?

Yes, time will tell. As of now, they do not have sufficient evidence.

I think it's obvious that the NCAA wants to take swift action on the matter

It's been 2 years and the NCAA hasn't done anything or really even shown a willingness to do anything so I doubt anything happens until everything is settled in court
