If it's new construction it's probably the contractors fault. I'd get after them asking for the ditches to be cleaned, claim they failed to provide sediment control BMPs. I'm sure AP has an ordinance requiring it. Next thing I would do is form a HOA, if needed you'll have capital to hire someone to clean the ditches
