It seems like this wouldn't have been a problem had it not happened during the school year. IMO, a 13 year old shouldn't be working 40+ hours during any time of the year. I could see 30 hours at 13 if it's spread out right, but not 40. And definitely not until 1 am. no matter what time of year it is.
