quote:Yes, there was a throwaway line to that effect in the intro to the first draft of the opinion. It was a stupid mis-cite.
It was earlier posted that this judge confused the Constitution with the Declaration of Independence in a previous ruling, but you are still willing to give this judge the benefit of the doubt.
Not sure how a careless reference has any bearing upon whether this judge is a stupid true believer or a disingenuous politico.

You would pounce on a Republican for doing the same thing.
But when it's a Democrat, it becomes a "throwaway line," among a litany of excuses.
This M.O. carries through with your posting and especially your criticisms.
You're nothing but a charlatan shyster.

Of course he would. The emperor has no clothes and everyone sees it. Hank still pretends he’s wearing a robe.
Reading the opinion reads like a bit from Animal Farm. “Gender is a deeply held internal sense of being a man or woman.” There’s no legal analysis. It’s just “Here’s what your overlords are telling you. Now suck it.”

You understand these are the same correct? The latter begets the former?
But I understand more about you now by your attempt to draw a line between the two.

My question is, some of these FTM trans people look and dress like men. They have beards even.
Making them go to the bathroom with women is a problem.

I don't know about Hank (I haven't posted here that long) but that absolutely describes a large chunk of the judiciary these days. This decision came down to "legal analysis" about as much as Obergefell.

Obergerfell was a bit flowery, but I never Understood how accepting traditional religious definitions of marriage isn’t an establishment of religion When a lot of religions now accept gay marriage.

Not safe for children to use public restrooms anymore. That is so messed up. These judges need to go.

I don't understand how this is an issue. You have a penis, off to the men's room you go. You have a vagina, off to the women's room you go. frick your feelings.

You ever seen a trans man?
Most look very much like dudes.
Every time they go to the bathroom would be an issue.

Scalia warned us. They'll continue to create laws that are in line with their personal political beliefs until they're held accountable.

Isn’t that what everyone does?
Isn’t that what people are doing by denying this?

Are you scared of taking a piss so close to a woman?
Do you have children, particularly a girl? Answer this and I'll make it painfully clear for your limited ability to understand the impact.

Sou you're OK with males and females (because that is all there is) using restrooms together? If so, do us all a favor and find a new country to infest.

I probably Wouldn’t send a child alone into any bathroom.
Because you don’t need trans rights to sneak into a bathroom.

I never cease to be amazed by the number of folks who cannot grasp the difference between the Constitutional limits as to what government CANNOT do and the political/legislative decisions as to what government SHOULD do.

teenagers are no better... in fact this would make it ripe for sexual assault cases and ruin a lot of kids lives for nothing. This ruling is beyond asinine in every aspect of the word.

Holy crap, man, did you skip civics class? No, it's not what everyone does, it's what duly elected legislatures do, or in this case (and this was a rule, not a law) it's what the school board elected by their community to perform this function do. And they answer to the voters, who can remove them from office for unsatisfactory performance.
Judges answer to no one and their job isn't to create laws.
