To put it callously, no they can't. When they kept the TRO in place, they have Trump plausible deniability if an attack takes place. It was his intent all along to have them hold it up in court, it gives him political coverage. If he didn't try to put the ban in place and instead said we are doing extreme vetting, and a newfound immigrant got and committed a terrorist attack, they'd blame him. But now they can't

This confuses me. If we have enough Intel to determine that they are in place and ready to attack, then I would think we would have enough Intel to stop them before an attack.

And if we don't have enough Intel to stop them before an attack, then how can we be so confident in the intel that says they are in place and ready to attack?
