No industry since the beginning of time will frick over a civilian like an insurance company.

If an insurance company has the choice of 1) paying a fair compensation OR, 2) paying a fair compensation PLUS a portion of the other party's legal fees, which would they prefer?

He has a pretty heavy rotation of sweep - "Call me to see what your case is worth" ads - 4 profit sharing partners that are mainly in car wrecks, 1 dedicated WC attorney, 1 dedicated SS disability attorney - and I don't know how many associates, but they are probably flung all over the place and doing a range of stuff, including class action (including Tom Galligan's son).
Now Richard doesn't do any car wrecks, mind you, but the firm lives or dies by them.

Plaintiff attys already use call screening to keep losers out of their office. Those ads "We are here for the poor people" would disappear from t.v. Not happening, just take a look at who in the Legislature are plt attys.

i went to the class action symposium in November and that's his baby and he had all sorts of national MDL people there to talk

if the "fair market" offer by adjusters was an optimal move, i'm sure one of the major insurance companies would have gone that direction by now (b/c it would lower costs and they'd be able to seize market share by this shift). since none of these companies do this, i have to believe they have done their cost/benefit research

The last thing any adjustor wants to see right now on a claim is a plaintiff's attorney. Yet they still don't offer these magical fair settlements that Russian expects.

I'm a lawyer and I've dealt with insurance companies for 16 years. How many years do you have dealing with them? werent you a banker?
Here is what you dont get, both sides of the bar, plaintiff and defense are oppossed to loser pays, it is not going to happen.

Since you are a lawyer your opinion obviously doesn't matter. Instead we are going to invite IT people to fix the legal system. And attorneys will fix the nursing field and so forth and so on.

You are so blinded by how the system works now you're not comprhending how a change using loser pays would create an entirely new financial incentive basis.

as a general rule, most tort reform ideas are attacked by both (at least behind closed doors). defense attorneys rely on litigation as much as plaintiff attorneys. if the lawsuits dry up, they lose their industry, too (lots of TX defense attorneys i know talk about this)
