I would like to see it taken a step further to make people think about the step they are about to take. A death certificate should be issued and the mother should be asked which burial arrangements she prefers and be informed that she will be given a copy of the death certificate.

Yes, I believe that may open the door to redefining what constitutes "human remains". Why wouldn't partial human remains meet that criteria?
Should there be a difference in disposal requirements of human parts if you believe the rest of the person is dead or alive? Serious question...disastrous car fire, only a few fragments of tissue/bone remain. Are those required to be buried?
I believe all human remains/bit and pieces regardless of gestational status should be handled as potentially infectious and disposed of appropriately. If the family wishes go above and beyond that, then so be it. Why should government dictate what to do with a body beyond that?

Death certificates will often include a date of birth.
Since it will never have been born what will you write in?
