Bogalusa in the news for other than being the stinkiest city.

A city court judge in Bogalusa, Louisiana, is operating a modern-day debtors’ prison by illegally jailing indigent people unable to pay fines or court costs – including a man fined for stealing $5 worth of food to feed his family, according to a federal lawsuit filed today by the Southern Poverty Law Center.
quote:
The federal lawsuit describes how Judge Robert J. Black routinely sends people to jail for failure to pay fines or court costs for minor traffic tickets or misdemeanor violations without determining why they can’t pay. The court is significantly funded through court costs and fees, creating an incentive for the judge to find people guilty and coerce payment through the threat of jail, according to the lawsuit. The court operates in a city where 35 percent of residents live below the poverty line.

So they arguing that only people with money should go to jail when they don't pay fines? How are they supposed to punish the people without money?

Punished for a speeding ticket or parking violation? Maybe set them up on a payment plan of $2 a week. You don't put them in jail.

And if they don't pay it?

I'd bet $2 that not one payment would be made after the one that allowed them to leave the courthouse initially
What people should be more annoyed with is the courts jailing pretty much every dad who can't pay child support. Then, they lose their job and still can't pay child support and go right back to jail

I think they are looking for a "get out of jail free card" like the fine citizens of Ferguson Mo

You understand these are exclusive issues?
Tell me something. Let's say the tickets and fines are $250. So the Government is looking to gain that much. The offender can't pay. So they throw him in jail and incur costs of at least $25 a day that they will never recoup.

If they don't pay a $150 fine, putting them in jail and costing tax payers $85/day seems like the wrong sort of deterrent.

Kill their children and burn down their house!
Seriously. Let them rot in jail and cost you, the tax payer, more money?

Good, we need more of these, especially with these assholes who don't want to pay their student loans.

This shite isn't anything new.
Have fun explaining to the probation or parole officer that you're having a hard time finding a job to feed yourself and pay restitution and supervision fees.

So why should I be required to pay a fine if they aren't?

I really thought it would have been much higher...

How about don't break the law if you cannot afford to handle the consequences. And on the court side...how about have them work in and around the city to pay off fines if they can't afford them. At least you could get the city looking better on unpaid petty crime fines

When the defendant pleads or is found guilty, the Judge offers the option of jail or a fine. It is the Judge’s right to send the defendant directly to jail if he chooses. Also, I am under the impression that these "extension fees" were only requested after an initial time period to pay the fine had lapsed. Being that all of the jails in the State are crowded, I believe that the Judge took serious consideration the ability of the defendant to pay the fine. If the SPLC gets their way, the extension fees will be terminated and criminals will be sent directly to jail without the luxury of time to get their money together.
And after a quick Facebook stalk, Rozzie Scott who “stole food to feed his family” looks like he can certainly afford cigarettes, a smartphone, and a Nike watch. The article says he is scared he will be sent to jail. IMO, you should be scared you will be go to jail if you break the law.
