It's unfortunate. I agree that it sucks if she tried to delete them. But it still made it to the school and it was her responsibility
If I use a personal jump drive for work and thought I erased some dick pics that were on it (I keep all my dick pics on jump drives). Go to do a presentation and they pop up because I'm a technology retard, I can still see why a company would want to fire me.

but it is relevant...information on a dvd can only be accessed by playing that dvd...digital information, even if originally recorded and stored on a physical device, can be accessed by means other than that physical device (i.e. the cloud), even after being removed from that physical device.

No it wasn't. DVD one point of access, a phone depending on what medium was used to capture and send the image can hide it in several places. A teenage boy who probably takes girls phones from time to time would know exactly where to look.

Not the same. If Joe from down the hall borrowed your jump drive off your desk while you were away found the file and emailed it to a bunch of coworkers and clients then yes it would be the same. Imagine that happens and Joe had received zero punishment and you were forced to resign?! That is what happened here.

They were in the "gallery" she said, so basically right on the camera roll.
DVD or a phone's camera roll, either way nudie pics were seemingly easily accessed.
Can we also talk about how dumb you gotta be to be a teacher of teenagers, leave your phone unattended with nudes on it AND to not have a lock screen on it? Geez.

The image was sent to multiple kids. I am willing one or more of these moms knew someone and got the ball rolling because poor Timmy saw breasts.

I could still see being asked to resign. I had dick pics at work. It was an accident, but they shouldn't have been there.
I'm not for it, but I can see a way a company can use it as a viable reason.

I read both. If the teacher took the picture in a messaging app that saved it there would she know it was in the gallery until after the fact?

No. You're talking about different issues.
You said that a porn dvd is the same as a nude on a phone. You said that physical vs. digital is irrelevant. I simply stated that physical vs. digital is relevant in the context of your second issue...the dvd porn.

Also, I believe the incident is under review by police against the kid, so you're technically right about zero punishment, but it is a bit misleading as punishment could come the way I understand it

For some reason , some here think that only one can be wrong in the scenario. Both were wrong. One may have also been illegal ((student).

If I accidentally had something on my jump drive that someone accessed by stealing my jump drive then knowingly distributed my personal property off my personal property? I would feel slightly culpable but if I had a union job and was told on the spot I had to resign, I would definitely sue.
The argument that began all this rhetoric was that she had no leg to stand on in a lawsuit. She absolutely does. Think of the very precedent being set. Think how flawed the legal system is and how this precedent could be perverted to where eventually the teacher is arrested and found to be a pedophile. The legal leap is not near as vast as the common sense leap in this argument if this precedent is set. If having the picture on her phone was accessible and available then why can't she be charged?
