Depends on if you are talking about DPF and DEF deletes and not only an EGR deletes...
With EFI live the tuner that did my 01 LB7 could make that truck run cleaner than a stock 01 while obtaining 400+ rwhp...mine was federal emissions...so no egr...later they put the egr on even the federal emissions LB7's
In the Duramax world there are exceptional tuners that I know that can build a smokeless low emissions tune for DPF deletes that would pass any emissions test while tuning for big power.
The DEF is a tough one to beat, but they can make big power even with the DEF treatment still on

There is no way a tuned and deleted truck would pass a sniffer test. Not even close. EGR is a huge part of controlling NOx.
Check your warranty papers if you fail an emissions-related component. I believe the EPA requires manufactures to warranty those components for a good bit longer than the regular powertrain coverage. I doubt it's 200k miles but check it anyway.
