Some states have separate open container violations.

Someone you know was killed by someone who had one drink and was impaired enough to affect their driving?

No but you should be arrested for open container and drinking and driving.

Why waste money on this? Logically, what's the difference in having a beer in a bar and driving home or drinking a beer on the way home, if you're under the limit?

I wouldn't do it because I don't want to get an open container but it doesn't magically make you drunk because you're behind the wheel.

Never said it hurt anyone. It's just odd you're justifying driving with an open container, breaking the law, because you worked 60 hrs in a week. So if by chance you get pulled over, you can just say hey, this is my reward??

Meh, I justify breaking foolish traffic laws all the time. On my route to work, there is a red light with a no right turn sign for absolutely no reason whatsoever. I turn right on red probably 3-4 a week. Why? Because it's a stupid law that wastes people time and doesn't make anyone any safer on the road.

No, because you were also texting your boyfriend while drinking and driving.

I have driven home many times after a few drinks and never came close to running red lights/speeding/what have you...much less kill/injure people

That is the sentiment of most people, right up until the moment of impact. I don't have the words to express what I feel needs saying.

That's an incredibly inane thing to think. Shockingly inane.

if you are coming at this discussion from an emotional argument, then you need to have that discussion with a counselor or psychologist. emotional comments have no place in a discussion about policy

I have a question. Let's say I have a heart condition, and if I drink too much caffeine my heart beats really fast. Let's say that I drank an espresso for breakfast, then a monster around lunch and a 5hour energy at 3:00pm. I get into my F250 at 4:00 start driving home my heart starts racing (not like anything you have experienced), and it doesn't stop for 15 minutes. I black out. What should be the consequences?

Wouldn't that mean you were Driving While Impaired?

ETA: Caffeine is defined as a drug so it should be the same consequences right?

This thread has focused on drunk driving but a DUI could mean anything as others have said. When they pulled her blood and charged her with DUI it could be alcohol, something her doctor ordered like pain pills or anti-anxiety meds. Could be weed. A DUI leaves everything on the table until the toxicology is released.
