Anesthesiologist & Medical Assistant: vicious commentary with a sedated patient

quote:
Sitting in his surgical gown inside a large medical suite in Reston, Va., a Vienna man prepared for his colonoscopy by pressing record on his smartphone, to capture the instructions his doctor would give him after the procedure.
But as soon as he pressed play on his way home, he was shocked out of his anesthesia-induced stupor: He found that he had recorded the entire examination and that the surgical team had mocked and insulted him as soon as he drifted off to sleep.
In addition to their vicious commentary, the doctors discussed avoiding the man after the colonoscopy, instructing an assistant to lie to him, and then placed a false diagnosis on his chart.
listen to the recording

How much is his lawsuit worth?

They said they wanted to punch his lights out for being a wimp.
I thought it was kind of funny.
But this part:
is inexcusable.

Insulting an unconscious patient isn't going to be the meat of the lawsuit. The last paragraph of his quoted passage is where he's going to get paid over.

Going to play well in court.

Loss of license is probably a given, maybe jail time? I'd say at least a million? And I'm sure an in depth look at former patients is going to bite them in the arse as well.

They'll all lose licenses and the malpractice insurer will pay at least a million. I have seen cases not this bad that paid more. Not all of that will go to the guy though.
Doubt jail time is involved unless they find out this was repeated behavior and patients have been hurt because of it.
ETA:
Just saw the 500k post. Very surprised.

Anyone else think this is awfully convenient? Is it a stretch to say he knew someone that was familiar with this doctor's lack of professionalism, so he acted out to draw her ire while secretly recording it.
Maybe I'm paranoid.

$500,000 for THAT?!?!? They said hemorrhoid sad a diagnosis and she took a shot in the dark with it. It's not like they told the dude he had AIDS.

Did any of y'all read the actual article?
It answers many questions in this thread.

quote:
One of the jurors, Farid Khairzada, said that “there was not much defense, because everything was on tape.” He said that the man’s attorneys asked for $1.75 million and that the $500,000 award was a compromise between one juror who thought the man deserved nothing and at least one who thought he deserved more.
“We finally came to a conclusion,” Khairzada said, “that we have to give him something, just to make sure that this doesn’t happen again.”

I have a friend that is an MD, and my SO works in a hospital. The amount of "making fun" that goes on behind patients' backs is pretty alarming.
ETA: Now MDs, like cops, should fear of being recorded.
