Unlike the state, he actually had a rightful claim to the blood.
This isn't the wild west or warlord frontier. We have a civilization with a system in place to handle law. Any time it is taken into one's own hands and ignored, the ideals of justice for the system are further eroded.
And finally, revenge is never noble or justified, even if you are in the right, if one is not also willing to accept the consequences.

Manslaughter
That's what I'd think. But I took criminal law in 1986. Been a while.

I wonder how many people saying he should be convicted of murder actually have children? Let the man walk.

He's right.
Eta. I have two children. The victim was someone's child. The victim had a child.

Obviously you do not have children

If the state had the gun and residue, manslaughter would be my case for the defense.
As is, I'm sticking with telling the state "convince this rural Texas jury that he's guilty after his kids were killed and you have no hard evidence."

because that matters.
having children doesn't excuse you from first degree murder.

Now that's a bold damn statement there for anyone who has been here more than a few hours. He'll, I've personally posted dumber things today.

are you implying the guy who got murdered isn't a victim?
if anything, the premeditated revenge murder is far worse than the drunken accidental killing. that guy didn't set out that night actively trying to kill 2 kids. the father went out with every intention of killing the man and he did.

That's some dumb shite right there. You don't applaud someone that murders someone on the street. Not when Your dumb arse has your kids out at midnight pushing a fricking truck down the road because you have run out of gas. I bet they didn't even have the common sense to have the the fricking flashers on. I hope he goes to fricking jail

Yea, well he did. Two fricking innocent kids. They didn't have a choice. The driver did have a choice. I'm not condoning the father's actions, but the real victims here were the innocent kids, not the drunk dumbass. We have laws and a justice system for a reason, but I'm glad that he's dead.

Some of yall are truly deranged if you think that having kids pushing the car basically merits the death penalty for them.

He should be convicted and go to prison. But, in a similar situation, I too would have murdered a drunk driver who had killed my two sons. It's a crime I'd be willing to pay the price for.

he did not ACTIVELY set out to kill 2 kids.
you could argue he passively did because he got behind the wheel drunk knowing what could happen, but he did not intentionally kill them. arguing otherwise is stupid.
he is a victim because instead of being given his due process as afforded to EVERY US citizen by the bill of rights, he was gunned down by a vengeful father who decided to take the law into his own hands.

That doesn't fricking matter, he did. If he was still alive, do you think he'd say "hey, sorry about your kids, but I didn't mean to do it!" I'm sure the kids' mother is consoled by the fact that he didn't ACTIVELY set out to kill them.

I couldnt give a flying frick what his intentions were. He ACTIVELY was the driver when he plowed into them drunk. He wasn't PASSIVELY driving, was he? (unless he was so drunk he was asleep at the wheel).

Texas doesn't have first degree murder, so he's just charged with murder. I doubt it fits the criteria for capital murder since the guy wasn't a cop or anything.
it was definitely premeditated and if found guilty, he will deserve the punishment.
