So what say you rex?
As MOST legal scholars and Federal justices agree, the intent of the law and other language within the law makes it clear that a Federal exchange can fully take the place of a state exchange when a state elects not to conduct one.
glad to know somebody finally read the entire bill ...

just a drafting error, right?
This entire shite show of a law was designed to be this way. The DEMs rammed it down the throats of an unwilling public using their normal shady tactics and had no idea of what the words in the law really meant.
it was their intent all along to just do what they wanted when they wanted to.
The GOP was correct in their every damned objection to the shitshow. The scum DEMs lied about every important element and now. All they wanted was the 'act' passed - they would implement what they wanted when they wanted and ignore what the words actually said.
Hence, count-face Pelosi = "we won't know what's in it til we pass it.' She knew i the words in the law didn't mean anything.
I hate these people.

Well, it's likely to pay off when the full DC Court of Appeals reverses the absurdly hackish decision released yesterday by two Bush partisans.
But, the 3-0 decision where the judges found there to be "ambiguity" in the plain language that limits subsidies only to persons using exchanges "established by the State" is not hackish?
The three judges appointed after the Senate rule change away from the previously required 60 vote super majority means an 8-5 majority of Democrats to Republicans on the full panel of voters who would issue the en banc decision.
Why does party matter for applying the law?
Reid's rule change might have saved another US Supreme Court deliberation of Obamacare, too, since they are far less likely to take on a case where there is no disagreement among district courts of appeal.
"Far less likely" - no. Less Likely, yes.

MOST?
Give us the numbers Rex.
And, the ONLY Federal justice that could agree to such lunacy is an Obama or Clinton partisan hack nominee who gets his/her marching orders from the DNC.

Exactly what do you think a Republican speaker can do with the nuclear option when there's a sitting Democrat president?
If Harry Reid can lower it to 51, a Senate Republican leader can raise it to 70, or 80, or 90 -- or whatever he needs to make sure that Odummy doesn't make a single appointment during his last two years in office. And, unlike Dingy Harry's power grab, this will also apply to Supreme Court nominees.

On June 14, 2005, the Senate confirmed Griffith by a vote of 73-24. Twenty Democrats joined fifty-three Republicans in voting for Griffith’s confirmation. (Two Republicans and one Independent did not vote.) Democrats voting for confirmation included Barack Obama, Joe Biden, Minority Leader Harry Reid, and Minority Whip Dick Durbin.
Next.

Yes. Because the Republican leadership has the balls to do that.

Rex I am sure you won't complain once when the R's have the Senate and use this option, right?

That's one of the dumbest things I have ever heard. You essentially shut down the Senate if you raise it to an absurdly high number (remember, the nuclear option applies to more than just nominations).
And, if you have a majority, why do you need to change the rules to block confirmation? You. Just. Vote. No.
The nuclear option is USELESS as long differing parties hold the White House and the Senate.
Posted on 7/23/14 at 1:19 pm to Rex
I bet you will be singing a way different tune if the senate is 51/49 GOP with a GOP president. I hope the next guy nominates Robert Bork in that scenario.

Really???
From the article ...
quote:
After years of threats and warnings, Senate Majority Leader Harry Reid (D-NV) and his Democratic majority on Thursday executed the "nuclear option" to eliminate the filibuster for executive branch and judicial nominees, except for the Supreme Court
And, you know damn well that if Odummy gets another Supreme Court nomination Dingy Harry will have no qualms about including THAT SCUMBAG in the nuclear option as well.
Now, what's the "dumbest thing you've ever heard"? Hint: Look in the mirror.

Great. You admit that Reid's action effectively took the blindfold off the scales of justice,
Say what? I admitted no such thing, not even implicitly.

It does not take a D appt'd judge to read between the lines you wrote to agree that you are in favor of judges voting in accordance to their party affiliations.

Rex. .. but how is this acceptable?
The nuclear option became acceptable when Republicans convened at the beginning of Obama's presidency and decided to block anything he tried to do, no matter what, even regardless of their own previous positions on matters, the country be damned.
At that moment the actual qualifications of a Federal justice nominee no longer mattered to Republicans, only that he or she were nominated by the President. Obstruction of Federal justice appointments thus began at an unprecedented rate, justice in courts was backlogged all across the country, and Reid, as a mere PRACTICAL matter, had to put a stop to it.

He knows damn well that the ONLY "TYPE" of person Oscumbag will appoint to the federal judiciary are fellow scum that have no regard for the Constitution or the law. They all get their marching orders from the DNC.
