Harry Reid's nuclear option to appoint Federal judges pays off.

Well, it's likely to pay off when the full DC Court of Appeals reverses the absurdly hackish decision released yesterday by two Bush partisans.
The three judges appointed after the Senate rule change away from the previously required 60 vote super majority means an 8-5 majority of Democrats to Republicans on the full panel of voters who would issue the en banc decision.
Reid's rule change might have saved another US Supreme Court deliberation of Obamacare, too, since they are far less likely to take on a case where there is no disagreement among district courts of appeal.

Only a complete moronic partisan hack could actually come out with an opinion that says "a State exchange" does not mean "a State exchange" -- like the 3 Dem appointed (2 by Odummy) intellectually and morally bankrupt scumbags on the 4th Circuit.

So are you saying that Obama appointed judges will rule based on partisanship and not the plain letter of the law?

Lord knows we need more judges who claim that they can't comprehend plain language so that they can insert whatever their favorite party needs at the moment.

Yeah, ruling on what the English language says is written the legislation is hackish.
And of course Reid's nuclear option is paying off. That's why the went down that road. They saw this case coming.
Regardless, SCOTUS will end up hearing this case and Roberts will get a chance to redeem himself. It only takes four justices to bring it up to SCOTUS, and you know what four those will be.

This will pay off when the supreme court gets the case. Both of those judgements yesterday really meant nothing. Just a stop along the way.

I can't wait until next January when NO OBAMA APPOINTEE will ever make it through the Senate -- including Supreme Court nominees. All thanks to Harry Reid and this nuclear option that scum like Rex love so much -- at least NOW.

There's NO legal philosophy that interprets "a State exchange" to mean something other than "a State exchange." It's partisan hackery of the highest order and any judge/justice who actually writes an opinion (or concurs in one) that says anything of the sort should be impeached IMMEDIATELY.

The en banc review panel would include not only the 11 active judges on the circuit, but also the two senior judges who were on the panel that issued Tuesday's decision.
