But, to answer your question. Saying something negative about a behavior(even a religion) is NOT "discrimination".

Clealy you didn't understand what i was saying. Is the first amendment the only reason the government discriminating based on religion is wrong? Or is it morally wrong for the government to judge that kind of behavior?
This isn't about statements, this is about the government being able to decide that an action that effect none outside the participants is wrong.
This is also about a group of people who have been prosecuted turning their backs and joining the prosecutors.
