Charter Service Trouble : Need Advice (UPDATE PG 11)

I booked a charter for an inshore trip well over a month ago for today. The guide called on Wednesday evening of this week to say he had a death in the family and could not make the scheduled trip today and needed to reschedule. I had 2 other men in my party that had definite plans and were hell bent on going fishing today. I also sent him a check for the $150 deposit a month ago and the check cleared my account Thursday of this week (day after cancellation).
Now comes the good part.....
I lucked out and was able to schedule another charter for today on Thursday of this week. We were able to go out and fish this morning and had a very successful trip. The problem is that we fished beside the guide that canceled on me for 2 hours this morning. I know for 100% fact that the first guide that canceled on me due to a death in the family and cashed my check that was out on the water beside us this morning.
At this point, I do not want to reschedule the trip he backed out on. I have already spent the money I had allocated for this trip, as I had to get another guide at the last minute when he backed out. I am torn between calling him and telling him I fished beside him today; and saying frick it, not worrying about my deposit money. The money isn't a big deal to me, but the more I think about how this all went down, the more I am pissed off.

He has requested to reschedule. The deposit would go towards the trip when we can make schedules work. My problem is that I was told he had a death in the family, then cashed my check. This locked him in to me being obligated to fish at some point.
Am I out of the deposit.... Yes, provided I tell him to eat a bowl of dicks and choke. No, provided I reschedule for the future.

Tell him to give your deposit back or you will makes sure every forum on the Gulf Coast will hear your story.

Tough situation. On one hand you wanna out him for lying to you but on the other you will lose that money. Maybe I would try to give him a chance to fess up to lying and work a deal out in a discount

Our guide said " you know the guy that cancelled on you due to a death in the family? Well that's him in that boat right there"

Thing is, he is a very well known guide too. Lots I advertising, press, etc.

I don't want to fish with him at this point. He was fishing with another guide today, shooting a video. I realize the weather has been shite the past few days and the video most likely wasn't recorded when it was originally scheduled. I just don't like the idea of me being told that he had a death in the family, then me telling my party this, then fishing beside the guy for 2 hours.

Just tell him you want your money back. Your deal was to fish today. He didn't keep his end of the deal. He's the one that canceled; not you.
