Texas, for one. You could not advertise the ABV. The Jester King v TABC ruling changed that, and the TABC is trying to find ways to go about a new method. Open The Taps has a good article here about it

Many states do allow it already, but that particular packaging would not have been allowed in Texas before the ruling

Yeah, I figured it was Texas. Just wasn't completely sure.
Hell I think it should be REQUIRED. Sometimes a 10% beer can really mask its ABV.
