The best of the best (imo) are (in no particular order):
Batman: Arkham Asylum
XMen: Legends
XMen: Legends 2
Marvel Super Heroes: Ultimate Alliance

I played that until my fricking thumbs bled. It was the first game that really felt like Spider-Man was web-slinging through the city.
It's also why I bought a Sega.

Picked up the GOY edition before I deployed but I am stuck on it.
Trying to get to Crocs lair to retrieve some flower for antivenom and I can't even get into the building.

My guess as to the why is, in the past the studios paid for the license of the superhero in question. They knew that now matter what they could sell (X) number of copies just on having the superhero in the game. They didn't put forth much effort because most of their budget was paid for the license for the character.
I would guess the payoff was just not their unless they triple or quadrupled their budget to bring in good writers, artists and coders. Even these days MOST video games based on characters suck.
