Trump’s FTC firing
In his second White House term, Trump has sought to eviscerate the traditional independence enjoyed by certain agencies across the federal government by firing their leaders without cause.

Those efforts will come to a head on Dec. 8, when the Supreme Court will hear oral arguments on the president’s bid to fire a member of the Federal Trade Commission (FTC).

Campaign finance
The following day, a major campaign finance battle heads to the Supreme Court.

The justices will consider striking down federal restrictions on political parties’ spending in coordination with their candidates, known as “coordinated party expenditure limits.” Republicans’ Senate and House campaign arms, then-Sen. JD Vance and former Rep. Steve Chabot (R-Ohio) challenge the limits under the First Amendment’s free speech protections. They appealed to the justices after losing in lower courts.

Pregnancy center subpoena
This Tuesday, the Supreme Court will consider a First Amendment case that touches on abortion.

quote:

First Choice Women’s Resource Centers, which runs five faith-based pregnancy centers in the state, is attempting to quash a subpoena from New Jersey Attorney General Matthew Platkin (D) under the First Amendment.

The centers do not provide abortions. Its health services are privately funded and provided free to patients.

Platkin’s subpoena demanded First Choice turn over donors’ names, their contact information and materials used to solicit contributions. Platkin’s office has said it’s part of an investigation into whether First Choice engaged in unlawful, “deceptive” practices.

Street preacher’s free speech fight
The campaign finance and pregnancy center cases aren’t the only free speech battles at the Supreme Court this session.

A street preacher in Mississippi will take his effort to raise First Amendment claims to the justices at arguments Wednesday.

Gabriel Olivier, an evangelical Christian, uses loudspeakers and signs to protest the message “that everyone sins.” He called women “Jezebels” and “whores” and men “sissies” as they walked by, court records show.

Brandon, Miss., officials arrested him under a city ordinance that criminalizes certain demonstrations near a public amphitheater outside of a designated protest area. Olivier was found guilty, and he paid a $304 fine.

While on probation, Olivier brought a federal civil rights lawsuit, saying the ordinance violates his First Amendment free speech rights.

I’m all for free speech but this sounds like disturbing the peace and harassment. Brandon, Ms is as red as red gets

He wasn’t protesting that message, he was delivering it

Probably not.

There is a significant number of street preachers who preach the theology that once saved, you don’t sin anymore and if you do, you lose your salvation.

what case is that? I know there is a similar one in Maine going before the state supreme court.

Gotta love the left.... A mom isnt allowed to practice her religion freely with her child, but if an administrator at her school wants to take her to a gender clinic behind her mother's back and have her reproductive organs removed, no problem.

I don't care what he called them.

Anyone else see Damani Felder's latest post on IG showing a list of the most vile comments he's gotten in the last week for being conservative and black? And that's protected speech. So preacher man can say what he wants, too, especially when it's the truth.

No, not entirely.

He can't use "fighting words" (is calling someone a whore or a sissy 'fighting words'? Probably not.)

He can't incite violence or make a credible threat against another person.

And he can't say what he wants to say in a manner that disrupts the public sphere. He can't block traffic, or a public sidewalk, for example, or make excessive noise.

I think this part raises questions - free speech and signs I'm ok with but loud speakers not so much

There's a very serious 2A case on the docket as well.

There's also Louisiana vs Calais.

I don't know the permissible decibel level that would cause it to constitute as a "noise nuisance violation". If it exceeds that threshold, then fine, he's guilty of noise ordinance violations. But free speech still applies regardless.
