Again, LSU can play chicken with BK

To earn his full buyout, there are several stipulations:

1) Payments will be made in equal monthly payments over the remainder of the original contract term (6.1 years).

2) Kelly is required to make good faith attempts to find equivalent employment. He cannot just retire and count his money. Failure to make a good faith effort to find employment would invalidate the buyout and he would no longer receive payments.

3) any salary/payment from the new job would be subtracted from what LSU owes in the buyout at the time. Unlike Jimbo, Malzhan and Freeze. Kelly’s is similar to Franklin’s with Penn St.

Again, if LSU wants, they can force him to make legitimate effort to find new work and the job has ti pay market value (can’t pay him cheap and use LSU buyout to bring salary up to market value).

If he refuses to do it, file suit for breach of agreement and he loses the remainder of the buyout.

It’s not that hard and he is using rumors and message board chatter to claim LSU is trying to cheat him.

Is that enforceable? Do we really think Ed O has been making “good faith efforts” to find employment since 2021?

That wasn’t a part of Orgeron’s contract. He got the buyout no matter what.

Orgeron’s buyout was small compared to this one.
This will come down to how many skeletons Kelly has in his closet.
I predict it will be settled soon for about 35 mil.

The cause stuff is probably just behind closed doors negotiations that Kelly decided to make very public. It’s all negotiation tactics. Basically saying “Hey, take the 27 million because you’re lucky to get that considering X, y, z.” What that X, y, z is idk, but Kelly is the one playing hard ball people. He wants all of his money instantly and doesn’t want to do what he agreed to do when he signed the contract. I was shocked when I saw the narrative that was being painted. It’s a narcissism tactic.

Yet again I will ask.. where has anyone said he wants the entire buyout as a lump sum?

He wants close to it yes. Some numbers being thrown around is. I’ve heard 50 million. That’s close. And doesn’t want to do what he agreed to when he signed the contract.

Idk about playing chicken.. just a simple calculation of the future amount with a net present value calculation .. and a little reduction if we drop the requirement to look for work.. which is not much effort.. not many 12 million a year coaching jobs out there for him to send in the occasional application..

Or he could just say no.. give me 800k a month and I will dollar cost average 400k into the market and travel and party all over the world for six years..

We have no leverage.. cut a business deal and move on..

This would have all been.behind doors if temu trump stayed focused on Ten Commandments posters instead..

If we have proof of cause, that’s our leverage. I’m interpreting this lawsuit as Kelly’s attorneys attempt to reduce his downside.

Kelly wanted $43m lump sum to walk away. LSU rejected it. Now we are here!

Ed’s had a completely different agreement. IIRC he stayed employed for a while, had some sort of representation obligations (LSU owned his NIL?) and basically couldn’t take a job until I think around now….oh shite

That’s not as much as I was thinking. Still quite a bit. And not something lsu is required to do. Period. They can just continue paying him monthly for 6 years and force him to follow his contract like he agreed to do. Kelly agreed to it. Why is everyone attacking lsu?

Regardless, this public thrashing of LSU is simply a stronghold tactic. The one playing hardball is Kelly.
