A coalition of Democratic state officials sued the Trump administration Tuesday, asking a federal judge to force the release of food assistance funds for 42 million people that the U.S. Department of Agriculture has said cannot be paid during the ongoing government shutdown.

Attorneys general representing 22 states and the District of Columbia and three governors launched the suit days before benefits are expected to be cut off for low-income Americans enrolled in the USDA’s Supplemental Nutrition Assistance Program, or SNAP, on Nov. 1.

Despite holding $6 billion in a reserve fund, USDA said last week it would not process November SNAP benefits without fiscal 2026 funding approved by Congress.

The USDA’s refusal to provide November benefits runs contrary to precedent from other recent shutdowns, and even the department’s own Sept. 30 contingency plan that said the contingency fund would be used to continue benefits through the shutdown.

The administration has also shuffled some other money to provide funding for certain programs, but not SNAP.

The Democratic officials said those factors made the decision arbitrary and capricious, a violation of federal administrative law, and asked a federal court in Massachusetts to order the USDA’s move unlawful and block the administration from putting it in place.

“It is an abuse of discretion for Defendants to decline to use available appropriations, including the SNAP contingency reserve, to fund benefits for the mandatory SNAP entitlement program,” they wrote.

Why don’t they just end the shutdown that they’re conducting?

And Trump should ignore that ruling. This has nothing to do with Trump. This is on the legislative branch.

First they need to delete all recipients that are illegal or are here due to Obama’s flooding of Somalians and Haitians to strategic areas.

I think I seen a stat where almost half of the 42 million are illegal immigrants, which seems almost unreal and don’t quote me on it, but I did see something maybe on this board earlier

Hmmmm... I'm pretty certain that Trump has no control of the distribution of EBT/SNAP benefits without proper funding and authorization from congress. Too bad the senate can't get that pesky little, ol' CR bill passed without Dem support.

It would be nice if there was a way for him to help, but if he did that he would be acting like a king, and gosh-darn it, we just can't have that now, can we?

I think this falls under "separation of powers". The executive branch spends the money, but only if it's been allocated by Congress. I don't know that the judicial can force the executive to re-classify funds in order to force spending on a specific program.

Yep. 8 months ago they were screeching about how Congress has the power of the purse, but that was in defense of their money laundering operations through appropriations that DOGE was uncovering, so... (D)ifferent.

fricking MTG opened a can of worms.. This dumb bitch needs to go away. She made a post on X stating that the Republicans can open the Government back up tomorrow if they use the "Nuclear Option" - Now, Republicans are the boogie man because they don't want to use the nuclear option - they want the democrats to fold and eat crow - She should have kept her fricking big mouth shut.

These fricking so called Fake MAGA people, Podcasters and fake MAGAs in congress are pissing me off - that includes her, Tucker, Candace bla bla bla - Just shut the frick up and let things work out without you pieces of shite adding fuel to the fire

This is truly laughable. Why? Because federal government and state government are the largest employers of blacks in the nation. If you can force them to pay for snap surely you can force them to pay for people that have so-called employment.

Maybe a republican judge should order the democrats to vote yes.
