Supreme Court won’t weigh Louisiana direct sales ban challenged by Tesla

Tesla in 2022 sued members of the Louisiana Motor Vehicle Commission, composed of dealerships owned by individual commissioners, and the Louisiana Automobile Dealers Association, claiming they were abusing their control of the commission to take aim at Tesla’s sales model and push it from the market.

Tesla sells its vehicles directly to customers via company-owned showrooms and online, as opposed to utilizing traditional dealerships. Nine of the 18 commissioners, on the other hand, are associated with dealerships that Tesla alleges are competitors, which Musk’s company said violates its due process.

In the state’s petition to the justices, Louisiana’s attorney general argued that the 5th Circuit erred in allowing Tesla’s suit to move forward. A district court dismissed Tesla’s complaint but the appeals court revived several claims in a 2-1 decision, including the due process claim.

In short, Louisiana is one of about 10 states (according to Google AI) that completely bans direct sales from vehicles manufacturers to customers. For those who may have knowledge of or are in that industry, what is the point of such a ban? Why shouldn't a person be allowed to directly purchase their vehicle from the manufacturer?

HOW is requiring us to buy through dealerships good for the citizen? What exactly is this law protecting us from?

This State sucks so bad.

There was an attempt to pass it last year, but the LA Legislature thinks we're too dumb to navigate buying a car without going to a dealership.

You can buy both an IRA and insurance without an agent. Sometimes its better to go through an agent for those but you are not forced to unlike a car dealership.


Hopefully the states surrounding this crap can profit from the 10 dumb states.

There's a difference between "don't" (ie: can but probably shouldn't unless you know what you're doing) and "can't" (because you are prohibited by law).

Wish it was this easy. Louisiana people will just continue to buy the Tesla’s from Texas. Also dealer won’t be able to sell as good of a price now that Tesla is all- in on selling direct.

Part of me still respects La for doing this. Dealerships are great for small town and are always big contributors to a local economy.

Louisiana has to protect car stealerships. The only reason I can think of to ban direct sales is to allow these families who own multiple dealerships to continue to frick the public.

Oh LA, definitely gonna keep figuring out a way to F that up.

The whole dealership process for buying cars needs to be changed nationwide. I think the Tesla situation is done right.

Also, why i like CarMax. The back and forth BS with salesmen is dumb. Either person wants to buy the car or not, if they don’t like the price, they will move on to the next one

STF ALL THE UP. You know what would be better for small towns? Lower prices for cars without having to pay dealer fees and markups etc. Car salesmen have the reputation for a reason.

This process has some merit. A bar owner only has to establish a vendor relationship with one entity, and have access to a thousand different products, instead of dealing individually with each brewery and distillery. Same goes for the breweries and distilleries. Jack Daniels can deal with a handful of distributors instead of a million individual bars and liquor stores. I think it should be organic though, not mandated by the state.
