Insurance- how long to make a decision of a wrecked vehicle is totaled?

As the title states, how long should an insurance company take to make a decision if a car is totaled or not? Going on 130 days currently and it’s aggravating as heck!

If it’s not too long to make a claims decision, it’s not too long to develop a sore neck and back.

Mine took about 72 hours. Had a check for the full value ~24 hours after that.

Erie insurance and we’re in TN if that matters at all (maybe it does?).

130 days?? What the hell happened??

They let me know my truck was totaled in less than a week. Got the check the next day.

130 days?! Definitely not that long. It’s usually not over 3-4 days. Certainly not more than a week.

I bet they aren’t paying for a rental.

Just went through this. I had the decision back a day after submitting the estimate and received the offer for my car the following day. Can't imagine any reason it would take that long.

2 weeks max. Post what insurance you have so we know to never use them.

Holy crap. Something is wrong. My dad’s took 48 hours (it was obvious). Mine took 3 weeks cause it wasn’t as obvious.

Your claims adjustor just died and all you care about is your totaled vehicle.

Let’s see… car got dropped at the shop at 11 after the accident. Got a call from the estimator at 3 that she stopped adding the damages at x amount and there was still more to go. Insurance called the next day.

If it takes 4 months it’s got to be totaled. A month is long enough.

It’s like video reviews in sports. If you can’t decipher what happened within 30 seconds, one minute at most, go with the call on the field.

A few days. Week at most.

Call the adjuster, get their supervisor on the phone, and tell them that if they haven't gotten back to you with a decision by the end of the week that you're contacting a lawyer on Monday morning. 4 months is ridiculous. You're about 3.50 months more patient that I would've been

Give more details. Is your vehicle in a shop torn down? What has the company told you thus far?

Is this your insurer or another party's carrier?

I had my truck hit by lightning while evacuated for Hurricane Laura in August of 2020. Truck electronics were fried but dealership couldn't get power to the truck to figure out all that was wrong with it so they couldn't give insurance an estimate and due to covid supply chain issues they couldn't get parts to figure anything out. Geico drug things out for 5 months. When I called them and told them I'd no longing be dealing with them and for now on my attorney would be handling all correspondence I had a check in less than a week. Attorney never even had to call them.

It's been probably 20 years since I've had to deal with the crap you're going through, but IIRC there's a 75% rule. Meaning if the parts, labor etc. are at or above 75% of the blue book value, then they legally have to total your vehicle. In either case, the 130 days is an unfair claims settlement practice and bad faith in their 1st party coverage to make you whole, so there are additional bad faith penalties you're entitled to. Assuming you're in La., file a complaint with the La DOI. I believe the link is directly left of Tim Temple's picture on the home page.

Could be that the vehicle is not "totaled" but there are still a global supply chain issues. I went through this a year ago. At some point it became more economical for the company to total the vehicle out then keep paying for rental, etc. even though the vehicle was repairable.

Mine recently took about 1 week. Got a surprisingly good payment for it too.
