This is how you tell someone you don't know the difference between civil regulations and criminal law without saying it ..

Value is an opinion by definition. The argument alone is the most subjective kind that exists.
The only way to prove fraud or fraudulent intent is with a smoking gun or by proving fraudulent damages. Without either, this case should have been DOA when it came before a judge.

I am amazed at how stupid and dumb the powerman poster always presents himself . It has to be an act, right?

The question is was Trump attempting to mislead the bank in order to get the loan, thereby defrauding the bank. The bank says no.

Fraud
A false representation of a matter of fact—whether by words or by conduct, by false or misleading allegations, or by concealment of what should have been disclosed—that deceives and is intended to deceive another so that the individual will act upon it to her or his legal injury.

This is all so dumb.
I’m no real estate developer, but if he wanted to save money on his taxes ( as they allege ) wouldn’t “grossly overstating” the value of his property be a really fricking dumb thing for him to do?

What an idiot...

If so, you are definitely in the lead.

The law of fraud in NY doesn’t require
the victims to complain or even suffer significant injury. It’s the act itself that meets the elements of the crime.

Is this a criminal trial?

You're talking to Powerman.
He doesn't know the difference between his arse and a hole in the ground.

I see his posts on other forums here and he seems like a completely reasonable and likeable poster, but anything Trump related, he blows his gasket. It is true TDS.

That was epic. And the CNN anchorette didn't even badger or attack him. Not too much. That was almost proper journalism on display.

He's still gonna get hit though despite it being complete nonsense.
Which will further validate Trump's and America First claims of a Two Tier Justice System .

How do you commit fraud when the lending institutions themselves are required to do their own due diligence before giving the Trump Organization a loan.
I've had several mortgages and small business loans, I can tell you the lender checked my loan applications with a fine tooth comb to make sure my information was legit and their risk assessment was accurate.

Have any of the people advocating fraud in this case ever had an appraisal of real estate. There are a number of methods to establish value. Valuing an operating business is even more difficult because of goodwill as Trumps lawyer has contended.

really?
can you be guilty of murder if nobody was killed?
can you be guilty of robbery if nobody got robbed?
can you be guilty of rape if nobody got raped?
etc.
etc.
quote:
Either his business committed fraud or it didn't. Whether or not someone was the victim of that is immaterial.
if his business committed fraud, then somebody IS the victim of said fraud.
fraud by definition is "deceiving people"
the people who were deceived are the victims.
if there was nobody deceived, then there was no fraud.
quote:
If I speed and don't cause an accident I'm still breaking traffic laws
you are aware that not every crime requires a victim?
fraud is not one of those laws.
