Either this makes it to SCOTUS and they parameterize "sensitive places" or this precedent will lead to more infringement and more abuse.

When (hopefully not “if”) this reaches SCOTUS, there is the opportunity to parameterize “sensitive places” but there is also the opportunity to better define what the government can and can’t do under the guise of public health. Narrowing that would be a huge win.

NM has always been the retarded cousin of Cali, Arizona, and Texas with regard to a lot of things.

Yes, to an extent. I lived there for 5 years. Unfortunately it is like a lot of other place where the population of cretins, animals, and marxists in the cities outstrips the salt of the earth conservatives who actually pay the taxes to make shite work.

Population wise it makes Mississippi seem crowded.

I went to about 3/4 of the state on one trip. While Albuquerque is big, the other sizable towns like Santa Fe, Farmington, Roswell, etc, were fairly small by most other standards.

Yet most of the places in between were virtually deserted.

It’s being appealed right now. No way she ultimately prevails on that. Commie bitch.

this was a public health order from the governor

I don't recall the part of the Constitution where a public health order overrides the Bill of Rights. Perhaps the judge can point it out for me because "shall not be infringed" is as concrete as legal language gets.

It’s in a penumbra and enumeration somewhere near the right to privacy.

There are NM State Police stationed down in Eddy and Lea Counties who I know for a fact will not enforce this.

Mass murderers love those "gun free" zones.

What is the intention of the law. If its public safety, do you honestly think a person intent on harming someone is going to abide by this law, of course not. Then what is the true purpose, to restrict the 2nd amendment, its thrown out.

This is correct - but we can't count on the federal judiciary here.

Unconstitutional doesn't matter what this judge says. There is no such thing as a sensitive place.

When you become Prez what are you going to do about something like this?

If you would keep up with my campaign videos you'd know:
- Prosecute this governor and others like her for conspiracy to violate rights under color of law. What she's doing, and what Gavin and Hochul are doing is transparently adversarial to the 2A.
- Cut off federal funding to the state.
- Take weapons and ammo from parts of the Executive Branch where it's not needed (like armed agents in the Dept of Ag for example) and redistribute these things. Part to DoD to have more ammo for training, but also to states like NY, CA, NM and similar places. And work out a deal with FFL holders to sell to citizens, and ask these citizens to sign a pledge that they will be ready in case we are attacked like Israel was attacked. US citizens making such a pledge will be considered voluntary, unpaid agents of the federal government and if the governor of NM interferes with them, then I'll arrest her for interference with a federal agent in the performance of duties.

In many ways, NM is a beautiful state. It's too bad that is gets ruined by leftists.

They often talk about "the general welfare" as justification for such things.

I don't understand the Judicial system in the least. how does any gun law pass constitutional scrutiny? imagine someone somewhere saying "yeah.. 200 dollar arbitrary tax and 10 months of arbitrary wait time definitely doesn't limit or undermine (definition of infringement) 2A rights"

and then imagine everyone not having a problem with it for nearly 100 years.

and now they're like... ehhh you can't keep or bear arms in "sensitive places" or if we declare flu season. definitely no limiting or undermining there. deal with it plebes

FCK that..

I’m sure there’s and actual term for it, but I call it incremental tyranny. Look at the number of conservative/libertarian types right here who sing the praises of Heller and Scalia, when at best it violates the constitution by qualifying where Americans have the right to keep and bear arms.

Normally, I'd say let the court work it out. But... she's a greater "threat to democracy" than anyone on J6.

Many times this has been construed as a place where, presumptively, armed law enforcement is present and thus protection is afforded and so one does not need to personally have a firearm for purposes of self-defense.

Armed law enforcement represents the goooooooooooooberment. I believe one of the purposes of the 2nd Amendment is to protect us from tyranny. Why are we denied the 2 A right just because it is a gooooooooooooooberment building or the presence of law enforcement is there?

Shouldn't goooooooooooooooooooooooooberment fear the citizenry?
