They are still maximizing happiness based on their perceptions. You could think about that several ways. If it's necessary for them to live, it's not difficult to see that as a happiness maximizing decision.

"if it works" can only be defined relative to other alternatives. Mercantilism "worked" for hundreds of years because it was the best method conceived; no one could imagine anything better. It wasn't until a better alternative was proposed that people realized this method to be sub-optimal.

The Fed gov isn't doing anything to mandate that states create a new tax through highway tolls, or anything like that. They are simply overturning a ban on states raising revenue in the way they see...
