In criminal investigations, in which the employee can be charged with a crime the employee has the right to council and the right to not answer questions.
In Administrative investigations, the employee does not have the right to not answer questions and refusing to answer...

The US Code is intended for the prosecution of government officials who disseminate classified info.
It is the government official's responsibility to guard classified info, not the public's.
