While these benefits are partially a product of the intense competition for qualified tech workers, they may also be a way for companies to simply increase compensation without giving the taxman a cut. And according to an article in yesterday’s Wall Street Journal, the I.R.S is taking notice:

"There is growing controversy among tax experts about how to treat these coveted freebies. The Internal Revenue Service also has been focusing on the topic, according to attorneys who practice in the area, examining whether the free food is a fringe benefit on which employees should pay additional tax.”

I predicted tax man would go after lemon aid stands,. I now predict we will be taxed every time we flush the toilet and it will cost more for a crap vs. peeing. As well as, there will be cameras and you will be fined $1900 if you flush cigarette butts down the toilet and an extra $1300 to smoke in your home. Weed an extra $500.

A place I used to work had free soft drinks for employees. The auditors told them it should be considered a fringe benefit for tax purposes. They ignored it and nothing else was ever said about it.

My wife just started working for Warby Parker here in NYC, and they do a lot of these "fringe benefits" such as free catered lunches etc. In her orientation they mentioned that the IRS may start taking notice to such benefits. So lame. I don't know how the IRS can prove you didn't pack your own lunch.

I'm sure what would happen is that the companies would have to start keeping a record of everyone who participates.

What if Google charged its employees 1 cent per paycheck to pay for their food? Then they could say its not free and not a fringe benefit.

This has been tax law for quite a while. Just looks like the IRS is looking closer in these "lean" times.
