Those are a little different. Everything else mentioned so far is 100% voluntary.

But are we sure about the premise of the OP? I remember a section of the bill where it said premiums could vary ONLY by three factors:

1) Age
2) Actuarial value of the policy
3) Location

Didn't see anything in that section about health or lifestyle factors.

Exactly... The young, healthy ones are subsidizing bad behavior. So why shouldn't the ones that aren't healthy and doing nothing to help their well being not have to pay more into the system?

I never get sick, workout everyday...but enjoy a good c I g a r on the weekends. should I pay more?

im in better shpae than 99 percwn of the population andhave. resting pulse rate in the 40 s

why ahould I pay more if I reward my near constant healthy bbehavior?

I have no problems with a private insurer making these kinds of decisions. But that's not whats happening here. The federal gov't is inserting itself into the marketplace.

While I agree with your overall premise there is an overabundance of hard evidence showing the perils of smoking. I have no problem with this

I'm sorry, but we need smokers, look up the numbers, we derive over $30B in annual tax revenue from smokers and the taxes they create. Where are we going to raise another $30B+ in revenue right now??

Should we raise taxes on everyone a few k to make up for cigarettes and just ban them altogether? I know as a gas station owner I really barely make $1/pack and could definitely do well without the investment to keep cigarettes in stock but as a nation could we survive banning cigarettes?

I don't mind a ban and keeping everyone healthy, but where will that $30-35B a year come from, I know I sure as hell don't want anymore tax increases.

NYC State and local taxes are $5.85 a pack. Costs about $12 a pack in NYC. Some estimates put at 60% the tobacco consumed in New York is smuggled in. Cuomo and the gang just increased the fine for each carton smuggled in to $600.

At those prices why even get insurance? It would be cheaper to pay the fine. Since they can't turn you down for pre existing conditions just wait until you are sick then get insurance.

That's the beauty of the free market. Aetna might decide to use body fat instead of BMI. Blue Cross might decide not to ding smokers, in hopes that they'll be on Medicare by the time they get cancer or emphysema. Humana might decide that fatties are too prevalent for there to be any benefit from charging them more, but people with STDs are irresponsible and should pay more.

Each company decides what risks they're willing to accept and which ones they're going to try to deter/avoid. Each individual has the right to decide whether they want to avoid the behavior or find a company more willing to accept the behavior.
