A man has been convicted of rape after taking off a condom during sex without his sexual partner knowing.
The landmark decision by the Criminal Court in Lausanne, Switzerland, determined that having sex without a condom constituted rape if the use of one was expected.
quote:
The unnamed man, from France, met a Swiss woman on dating app Tinder.
On their second date in June 2015 they started having sex with a condom, but the woman only realised it had been removed after it was over.
The court judged that the woman would have refused to have sex if she had known the condom would be removed

I actually don't have a problem with this although I believe it should be a different crime than rape. Something like "contraception fraud." It should also apply to women lying about being on birth control.

I mean, I can't say I disagree. She didn't consent to sex without a condom.

She consented to sex
What is next?
He lied about having a 9" dick? He said he would go down on me and didn't?

So is it rape if a woman lies about being on the pill?

If it can be proven that the man put on the condom and took it off without her knowledge, I'm fine with charging him with rape.
But, how was this proven in court?

That's where I am with it. It's a sleazeball move that can medical repercussions beyond pregnancy, but it's not rape.

What about lying about birth control?

Sounds like you don't even need to have one on and take it off, just not have worn one when it was "expected"

I suggest wearing a condom in Sweden. A post sex "you wore a condom right" can change your life real quick.

The main issue is how do you even prove it? Seems like the guy claiming it came off accidentally is enough for reasonable doubt. I have no clue how the French legal system works, though.
