On Friday, the Supreme Court rapidly expedited everything. The ACLU—which represents the plaintiffs—have been ordered to file their response by 3:00 p.m. on Monday, June 12. The ACLU lawyers must also respond to DOJ’s application for a stay by that time.

The Court could conceivably then vote immediately on whether to take the case, or anytime shortly thereafter.

It’s also possible that the Court could accelerate briefing on an emergency basis, then hold arguments over the summer, or possibly even in June before recessing for the summer. The Court could make clear by the week of June 12 which course it is pursuing.

I know this will sound nit picky and pedantic, but the Court has asked for a response to the petition for cert. If the Court grants cert, written briefs would follow. "Argument" is a term of art used solely to refer to oral arguments before the Court.

I appreciate to the layman those distinctions are minor, but for practitioners, your thread title reads like a tear in the space/time continuum

Since the "travel" ban was supposd to be for 90 days, until we could get our (super-duper) vetting in place, it seems like this is a moot point.

But I understand why Trump wants to go through with it. He wants the Supreme Court to get used to hearing all his matters on an expedited basis, and giving him snappy favorable rulings.

They often rule on a case while similar cases are in the works.

Then when a decision is made, if it runs counter to what the other case decisions are, the appellate courts usually rule to remand the case to the trial court to determine whether, in light of the case decided, their original decision still stands or must be changed.

For any legal minds out there, what's your assessment of this case? We know some liberal circuit courts have ruled against Trump, but what do you think the Supreme Court will do?

Is this a slam dunk in Trump's favor, or could it be a close decision?

You are correct, but you are assuming this poster believes in the rule of law. He/she does not and they want to make it up as they go along to fit their political agenda.
