Supreme Court of Texas- No inherent right to gay marriage benefits
quote:
“The Supreme Court held … that the Constitution requires states to license and recognize same-sex marriages to the same extent that they license and recognize opposite-sex marriages, but it did not hold that states must provide the same publicly funded benefits to all married persons,”

Dumb and will probably be eventually overturned.

Good-ish (they should have overturned Obergefell itself). The state recognises marriage and extends benefits to marriages for a reason. Homosexual relationships can never do that.

As a Texan, this ruling is dumb and not the hill to die on at this time.

I agree.

Well that's an equal protection claim just waiting to happen

When the gays would ask how in the world could gay marriage possibly adversely affect you, this is one of the ways right here. Taxes will have to go up to pay for the benefits of the spouses.
Having said that, they won, they can be married, and they are now entitled to everything that goes with being married. This ruling will not stand.

quote:I'm in agreement however I don't know how this ruling stands up given the 2015 SCOTUS ruling. I think that one should have gone the other way and left it up to the states to decide how they want to recognize marriage instead of forcing all states to view it the same way.

If Trump gets one more appointment, who knows?

Why are they gonna waste the Supreme Courts time by making them smack this down. Oh, it's because the judges are politicians who want to get re-elected in deep red Texas and are ruling based on that instead of the actual law.

Serious question: You think a state court has the power to overturn SCOTUS?

Obergefell will not be overturned. Never in the courts history has a civil right been granted and then taken away by the Court. Later courts may limit it but the central holding will stand. Rights granted are one of those once you open the box you can't put the lid back on type of thing.

Do you think scotus has the power to determine marriage license policy for the states? (Hint they don't)

I'm guessing you haven't seen what SCOTUS has done with the 2nd Amendment lately.

I mean, SCOTUS doesn't have to hear it, so if they want to use their time on it, they can. Ultimately, a similar case would have eventually made its way there.

SCOTUS was just forced to do the same thing for an equally stupid, unfounded, partisan, political ruling out of Washington state and Hawaii inre the "travel ban", and you didn't complain about that one. STFU.
