The only people that nominate moderates are Republicams ex O'Connor and Kennedy. Liberals asking ex clerks of Kennedy to stay on is insane to me. Roe will never be overturned but the idea that liberals should have any say on the Kennedy seat is nonsense.

Yea Garland got hosed but that was the Scalia seat and if you think Dems wouldn't have done the same thing for the Ginsburg seat then you are lying to yourself. Right now, the most important American alive might be Kennedy with the cases coming up including gerrymandering.

With all of the obstructionist crap going on, this might be the only true long-term benefit to having elected the candidate not named Clinton. I for one am hoping its true, and that Trump gets the opportunity to place another conservative on the court prior to mid-terms.....

It should be someone so conservative it makes liberals fricking cry. Until the left gives an O'Conner or Kennedy to the court just send them the Scalia's for now on

Yeah, right.

In a history of jurisprudence, this is all they know or care about. So pathetic.

The SC exists to protect Roe for them.

I'm far from Trump's biggest fan, but this is one thing I'm proud of him for. He did a good job the first go round. Hope he continues it. One of the main reasons I voted for him.

If Kennedy retires, I have no doubt that Ginsburg will soon follow. We could have a 7-2 conservative super majority on the Supreme Court by the end of 2018. Roe v. Wade will finally bite the freaking dust!

I'm hoping you're right, but in no way is my opinion based on Roe vs Wade......

And I hope it's Diane Sykes. She's thought of to be even a bit more conservative than Gorsuch, she's a woman, which I think the next nom will be, and she's relatively young. Plus she's another person that doesn't have a lot of baggage like a Pryor. Also, she was on the short list to get the last nomination.

Roe is probably the strongest stare decisis out there.

And it's just not political...but practical and historical.

SC isn't going to shut down a million planned parenthood clinics in America...because they can't enforce shite...

And any government armed with the decision isn't going to spend the money and political heat in trying to enforce the banning of something that has been legal for almost half a century.

It's like every civil decision...hey you won! Congrats, now try getting your money.

There's a difference between SC even remotely over-turning Roe and that actually being a practicality.

Since the Supreme Court is full of smart people and they know you can't turn back time and enforce shite already locked in - they aren't going to make a symbolic decision that matters little. The ball has rolled far down the hill...you can't roll it back up.

Hell Trump wanted to deport a few bad guys and states rebelled.

Imagine trying to enforce a repel of Roe in S.F.?

We would need Marshall law to repel Roe.
