Police smell meth, raid home, kill 80-year-old man, find no meth

The widow of an 80-year-old man who was shot dead by police during a drug raid on their home is suing for $50 million.

On the night of June 27th, Los Angeles County deputies raided the home of Eugene Mallory and Tonya Pate. Authorities claim they had probable cause to search the premises because they could smell chemicals used to make methamphetamine while standing outside the house. Police suspected Mallory of being involved in an illegal meth ring.

Mallory was asleep in bed when police entered his home. Pate said her husband has bad eyesight, and couldn’t tell that the men entering the house were police officers without his glasses.

What happened next is disputed by police and Pate. The deputies claim that Mallory pointed a gun at them, requiring them to take defensive measures. They shot him six times, and he died.

Does the link (blocked for me) go in depth as to how much marijuana they found in the sons room? I don't agree with the cops side of the story in this, I'm just curious if they are attempting to claim an amount that is obviously for personal use.

It seems like there are so many facts missing from this story.

I'm not withholding my opinion to wait on these facts, though, because the cops are also wrong.

I will say this, if we get a "clean" cops bust in the wrong house and some one gets killed situation, cops need to have harsher punishments than suspension ie Jail time.

Breaking constitutional rights due to "mistake" isn't a good enough excuse to me when you wield that type of power over the citizenry.

Was the pot in the form of a plant or in a bag? Either one is not going to waft too far from the dwelling. Why were they so close to the house that they were able to detect the unmistakable aroma of a meth lab in operation and how are they trained to determine the odor of such happening? The Bull shite of their story is Deep and Wide in expanse.

I don't want to know who's being sued; I want to know who is going to fry for crap like this. Probable cause over drugs is bull shite. So everytime they think they smell something, they can just bust in and shoot people?

I wonder what the judge who issued the warrant thinks about this. If he/she has any integrity, he/she should be really pissed that the ccps would lie to get a warrant.
