Part of the arcane Senate rules. Voting no is a procedural move that allowed him to bring up Gorsuch's nomination. He had to do this to drop the nuke!

This is a procedural move. he has to vote against it so he can bring back up the cloture vote after they get he procedural changes made.

since he voted against it he can bring it back up
