This is going to get good before it's all over with. I hope that they put a few of them in jail for long prison sentences. Then we'd see how many want to continue to stand on their convictions. The sudden about faces would be hilarious to watch.

I think that refers to the actual transportation of aliens, and with knowledge that the person in question is an alien.

I think the point is that the municipalities aren't going to go through the trouble to make that determination.

I don't think that law applies in this case.

If it were limited to (A)(i) I would agree with you.

But it continues on...

(ii) knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, transports, or moves or attempts to transport or move such alien within the United States by means of transportation or otherwise, in furtherance of such violation of law;


quote:

(iii) knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation;


I included up to "any building" specifically because what is often happening in these cities is that the local PD is instructed not to inform the Feds if they arrest (ie: house within their jail) an illegal.

(iv) encourages or induces an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law; or


By stating they are a "sanctuary city" they are indeed encouraging illegal entry into the country and specifically residence within their city.

(I) engages in any conspiracy to commit any of the preceding acts, or
(II) aids or abets the commission of any of the preceding acts,
shall be punished as provided in subparagraph (B).


It doesn't get much more exacting from that.

The AG needs to be working on criminal charges more so than focusing on withholding federal grants.

I'm admittedly ignorant of the whole 'sanctuary city' thing, so I'm not real sure if they are actually making the determination that the alien is in fact unlawfully in the country. I was under the impression that that is exactly what they are resisting doing. ie, it is not their job to determine status of individuals taken into their custody in the first place
