The Kentucky Obamacare marketplace has no “expectation of privacy,” warning its prospective customers that their information can be monitored and shared with government bureaucrats.

When clicking “let’s get started” on the state-run health insurance marketplace “kynect,” the user is quickly prompted to a “WARNING NOTICE.”

“This is a government computer system and is the property of the Commonwealth of Kentucky,” it states. “It is for authorized use only regardless of time of day, location or method of access.“

“Users (authorized or unauthorized) have no explicit or implicit expectation of privacy,” the disclaimer reads. “Any or all uses of this system and all files on the system may be intercepted, monitored, recorded, copied, audited, inspected, and disclosed to authorized state government and law enforcement personnel, as well as authorized officials of other agencies, both domestic and foreign.”

Such information includes Social Security numbers. When calling kynect to enroll in the marketplace a person is told to have their Social Security card, immigration status, pay stubs, alimony payments, student loan information, and current health insurance information at the ready.

The kynect disclaimer says users information can be shared at the will of state government agencies.

Kentucky has their own exchange. They "opted in". So this is a local government issue in Kentucky, for Kentucky to deal with. What is your interest in Kentucky?

Would this info fall under a patients confidentiality protections

I honestly don't know if it would or wouldn't. And if it would, does obamacare legislation pretty much terminate that right?

Seems the dems decided to get the whole enchilada with this power grab, they likely figured they might not get the opportunity again. It might be a travesty if they were to use peoples info against them. Of course they would never govern like that.

All they need to do is add another table in the DB with keys on name, address, SSN with data on political affiliation plus amounts contributed to candidates, and ACA will be set to roll. Oh, add gun registration as well.

Scales it back to the extent that the IRS will gain direct access to additional personal information.

Federal government bureaucrats will gain access to significant aspects of personal healthcare about participants it did not previously have.

Appropriate security of said information is left wanting. There will likely be little consequence to the predictable carelessness with which your private information is handled.

Being that a lot of the *Navigators* will come form the ACORN ranks, and have access to all your personal financial and health info, NC...it's easy to see how the Government won't be able to offer any "expectation of privacy".

Hell, the IRS went rogue...and I'll bet they had COLLEGE DEGREES. The ACORN bunch fresh off the community organizer street.

This, most likely, has to do with sharing information with other state benefit programs to help catch people lying about their income/resources.

The scary thing about the disclaimer is that it says they can share information with foreign agencies. I'm not sure what the hell that is for.

Most likely. I know that workers in the Medicaid, SNAP, and KTAP offices have to abide by HIPPA. I also know that many of the health benefit exchange workers are also the Medicaid workers (at least in Kentucky) so I can't imagine that they would exempt the exchange workers from HIPPA while all other state benefit workers must abide by those protections.
