I just want to make sure the Second Amendment is OK. Was it hurt? Can anyone confirm? Because that's all that really matters. The Second Amendment.

That's the kind of attitude that gets you killed by an attacker. If someone reaches into my car with the intent of doing me harm, I'm shooting them. Of course, my windows would have never been down and my doors automatically lock, so the aggressor would have already broken my window in this scenario.

I forgot in my post, UNARMED. So why does the gun come out?

We don't know.

That should have ended things and no one would be dead.

We don't know that.

Instead, he goes another step further and shoots it. That's where the line is crossed

We don't know that based on what we know. Maybe, maybe not.

You are entitled to use deadly force to protect yourself even if the other party does not have a gun.

And I don't know if the use of deadly force is justified here. Neither do you. You can't know based on the info we have.

It could still be in danger. Can it join you in your safe space?

I am guessing that most jurors would consider deadly force acceptable if you are a 54 year old man being pulled out of your vehicle by a 30yr old ex NFL player.

This tells me you have no idea of the standards for self-defense, nor do you understand the standards for evaluation in justifying deadly force.

Not sure if already posted but typical flame fanning leftist article from the NY Post about this situation...

quote:

The white man accused of gunning down ex-Jets running back Joe McKnight was released from police custody without charges — provoking rage from friends and family alike.

quote:

McKnight, who authorities said was unarmed, was standing outside his car when Gasser pumped him with several bullets

Huh? If he were going to "pull him out of the vehicle," wouldn't he have gone to the driver's side, not passenger side?

It can be buried in a coffin with the 30,000 other gun shot victims annually. We are sick.

Less information is better?

Would the gun come out if it was a woman?

Is there a woman involved in this individual incident?

Would the gun come out if it were an old guy?

Can an old guy attack someone?

Don't let objective facts get you upset when dealing with legal matters.

I don't know what happened before and I don't care BUT..

IF he stood over his body and shot him again, that should change it from whatever to murder, period

This is not what the law says.

There are elements that have to be met and there is no way to know the answer based on the info we have available to us.

Investigators will compile evidence and DA will pour over it to make a judgment call based upon a legal outcome whether or not to charge. There is also a chance that the US Attorney will have a look too.

True, but this is already in dispute.

No, that's not what it means. Using lethal force in a self defense situation does not even require that a gun must be present.
