Wow Bard, everything you just spewed is directly contradicted by the evidence made public.
The sheriff explicitly stated that all 3 shots were fired inside the car. He also said that the testimony of the stand over were false and that witness changed his testimony repeatedly.

The sheriff said that the incident (apparently) was a mutual road rage problem that escalated to a killing.

We can all believe that it was a tragic waste for a young man to die in a preventable needless manner. It was, and all of us should use this as a lesson to avoid such moronic situations. But it is up to a jury and legal facts to determine the guilt or innocence of the shooter under the legal definition of Louisiana law.

Spewing false information leads to outrage and more human misery.

The state would have to prove that his intent was to kill McKnight with the actual evidence accumulated in the investigation and that would be close to impossible.

Except that manslaughter requires the shooter to have been provoked in a a way that an average person would loose their cool and kill someone. Getting cut off on an exit isn't that.

Shooting someone 3 times is intent to kill. He didn't plan on it, but that still qualifies as 2nd degree murder.

Well McKnight did get out his car to confront Gasser. I'm guessing he probably wasn't asking to exchange insurance info.

So does inferring that I meant to do that.

The last I had heard on this was right after the event so this stance by the SO is news to me. So for the update and for the attitude.

Right, but when the whole incident started the state cannot prove it was started with the intent to kill McKnight, it is a much easier case to prove they got in an argument and in the heat of the moment, Gasser shot and killed McKnight.

Fact, the prosecutor thinks the evidence warrants a trial.
Fact, the defense thinks that the shooting was legal under Louisiana law.

Fact, neither you nor I know the complete facts of this tragedy.

My bias is that I want the justice system to determine the outcome in a legal manner. I want the guilty punished and the innocent vindicated.

The Only reason Gasser was arrested...He ran off at the mouth without Counsel.

Repeat after me- "Anything you say, can and will be used against you.

It is beyond foolish to give away any information without an attorney present. If not for Gasser's statements, they have 2 parked cars, some traffic cam footage, and 3 shell casings. Gasser remains uncharged without his diarrhea of the mouth.

Repeat the last attorney sentence any and every time someone speaks to you! Doesn't matter if that person is a police officer, a paramedic, or your momma! Only talk to your attorney after that person says "Ok, now talk to me."

I've developed a general disdain for Normand, but he handled this 100% correctly, although I didn't see/hear the press conf so can't speak to demeanor therein, which I hear was kinda overboard.

I believe that being the aggressor may bar the stand your ground defense; however, with this kind of back and forth scenario it's hard to tell when or if that (being the aggressor) would apply.

Kind of overboard? He literally got mad that people said mean shite to him on twitter and then read them aloud like Jimmy Kimmel's mean tweets segment done as a joke. The whole thing was unprofessional.

Agree. But at this time based upon the slim evidence that has come my way, I can see a defense argument that could lead to acquittal.
First this is a road rage situation that both moronically participated in.
After several miles and many minutes of back and forth screaming and stupid behavior, McKnight left his vehicle and approached the open passenger side window of the defendants car. After more yelling and screaming Mr. McKnight lunged through the window into the defendant's car. The defendant feared for his wellbeing from the much younger, stronger, more physically fit Mr. McNight who was changing the altercation from a verbal exchange to a very dangerous physical one that the defendant would surely be injured or killed by. Louisiana recognizes the defendant's right to use deadly force. He is not guilty!

I am not a lawyer and I don't play on on TV. My opinion is inherently no better from any other. And future facts can change everything I just wrote instantly. For example suppose McKnight was shot all three times in the back! That little ballistic tidbit would push me more towards the charge of murder than manslaughter!

Why does it bother you pajama boys so much as to what the sheriff said? He's speaking the truth. You'd better be thankful that it wasn't Harry Lee because he may have gone on more of a tirade considering how the queen of pajama boys, obama, has fricked up this country's toughness. Thankfully that coffee shop mentality has come to an end!
