They will. This is their exclusive province (and the Constitution actually says it is) and they will decide if the petitioner has standing to file the petition, not the state courts.

It's a stay violation and Rule 11 problem all wrapped into one. No matter how you slice it they are trying to interfere with the administration of a federal bankruptcy case. The fact that they're doing it through state collateral proceedings that don't nominally include the debtor doesn't make it any less so...it just makes them even dumber for trying. If there was a legitimate beef against the filing there would have been a motion to dismiss filed in the bankrupt y court.

i know, but until the bankruptcy judge can vacate this ruling, the guys who violate the order may end up in contempt in state court

now, if that happens, the judge will probably get sanctioned like a motherfricker
