Forcing people to buy insurance = Unconstitutional

quote:

Leader Steny Hoyer (D-Md.) said that the individual health insurance mandates included in every health reform bill, which require Americans to have insurance, were “like paying taxes.” He added that Congress has “broad authority” to force Americans to purchase other things as well, so long as it was trying to promote “the general welfare.”

Voice of reason.......
quote:

The Congressional Budget Office, however, has stated in the past that a mandate forcing Americans to buy health insurance would be an “unprecedented form of federal action,” and that the “government has never required people to buy any good or service as a condition of lawful residence in the United States.”

quote:

In 1994, the Congressional Budget Office reported the following about health insurance mandates: “A mandate requiring all individuals to purchase health insurance would be an unprecedented form of federal action. The government has never required people to buy any good or service as a condition of lawful residence in the United States. An individual mandate would have two features that, in combination, would make it unique. First, it would impose a duty on individuals as members of society. Second, it would require people to purchase a specific service that would be heavily regulated by the federal government.”

quote:

David B. Rivkin, a constitutional lawyer with Baker & Hostetler, told CNSNews.com that Hoyer’s argument was “silly,” adding that if the general welfare clause was that elastic, then nothing would be outside of Congress’ powers.

quote:

“Congressman Hoyer is wrong,” Rivkin said. “The notion that the general welfare language is a basis for a specific legislative exercise is all silly because if that’s true, because general welfare language is inherently limitless, then the federal government can do anything

the democraps just keep trampling on the ole Constitution, hopefully we trample on them come election time.

Hopefully if push comes to shove the USSC will stand up for the people and condemn this action if they try it.

There is no law requiring anyone to buy a car (and thus car insurance) genius.

Your car insurance analogy is wrong on so many levels.

1. It's not required for any citizen
2. You aren't buying it for yourself, you are buying liability coverage to cover others if you are found to be at fault.

Not sure how that would be relevant (if it was indeed a reserved state power) as the feds could easily require the states to require the insurance if they desired.

But the feds do on federal property and to bid on contracts with the federal government that require the use of vehicles, etc.

If the "state" requires hospitals treat everyone for their medical needs I have no problem with everyone contributing something to the costs, why encourage parasites and wreckers.

This is what is known as a "root cause analysis".

hey, "genius"...

you do realize that, when it comes to healthcare, the insured already cover the liability of the uninsured, don't you? just another reason why our costs go up every year.

No. You have to participate in the PRIVILEGE of driving an automobile.
