These recent Federal Judge rulings are just sickening. They are nothing but appointees by the Obama Administration to further his agenda

Leon was appointed by GHWB and Pauley was appointed by WJC

Yes, it's time to forget that every President since Woodrow Wilson has furthered the agenda from the previous one, and concentrate on our hatred of Obama while relishing in the knowledge that once we get someone in there with a "R" in front of his name, things will be all better.
You all do realize that the last president to set an agenda to decrease the size of the military and rein in our intelligence gathering was assassinated, right?

re: Federal Judge in NY Rules NSA Phone Surveillance Is Legal
From the Yahoo story:

quote:

In a 54-page decision, Pauley said the program "vacuums up information about virtually every telephone call to, from, or within the United States."

But he said the program's constitutionality "is ultimately a question of reasonableness," and that there was no evidence that the government had used "bulk telephony metadata" for any reason other than to investigate and disrupt terrorist attacks.

Only in the minds of statists is vacuuming up everything about the citizenry considered "a question of reasonableness".

The article is very limited in describing the scope of reasoning behind the decision but from what it does say, the decision wasn't based on legality as much as the ends justifies the means school of thought.

Ya, ABC news link was a joke.

Not much better, but offers a little more detail: Yahoo

I don't fear for my personal safety. Still very serious matter of concern though for all people. The potential for something very bad to happen is still there.

The overreach into spying on our citizens didn't really come about until around JFK's Presidency, imo. It all started with the Cold War and the fear of Communism

GWB was just as bad when it comes to freedom snatching with fear mongering. My point was taking away the Nuclear Option will just lead to more shitty judges in the future. And it will be easier to appoint them

He's a Pro-Israel Judge

quote:

A case that surprised many with allegations of espionage and even talk of the death penalty ended Friday with an 85-year-old New Jersey man hobbling out of the federal district courthouse in Manhattan, avoiding prison but fined $50,000.

With harsh words for both the man, Ben-Ami Kadish, and the government, the judge, William H. Pauley III, said prison would “serve no purpose” for a man so old and infirm, but made clear that he had lingering questions about the government’s approach to the case.

Mr. Kadish, who lives with his wife of 57 years in a retirement community in Monroe Township, N.J., said in court that he leaked classified United States military documents to an Israeli agent

quote:

Mr. Kadish, a United States Army Air Corps veteran, was born in Connecticut, and moved as a child to what was then Palestine and is now Israel, according to a document filed by his lawyer. He returned to the United States after World War II.

From 1963 until 1990, he worked as a mechanical engineer at the Army’s Armament Research, Development and Engineering Center at the Picatinny Arsenal in Dover, N.J., the complaint said.

When Mr. Kadish, who had a security clearance, was arrested in April 2008 and accused of spying, prosecutors said that he had provided Mr. Yagur with 50 to 100 classified documents, all of which he had borrowed from the arsenal’s library.

One document contained information about nuclear weaponry, another concerned a modified version of an F-15 fighter jet and another pertained to the Patriot missile air defense system, the complaint said. Mr. Kadish has said he did not ask for nor did he receive anything of value for the documents.

“I’m sorry I made a mistake,” Mr. Kadish, standing with the aid of a cane, told the judge before sentencing. “It was a misjudgment. I thought I was helping the state of Israel without harming the United States.”

As the hearing ended, Judge Pauley said that he was imposing the $50,000 fine “because you have the ability to pay it, and it can communicate to you something more about the gravity of your offense.”

Judge Pauley ordered that he pay the fine within 60 days.

“No problem,” Mr. Kadish said.

If it hasn't happened in the last 6 months and/or has not been formally announced on Fox News, it didn't/hasn't ever happened.

Signed,

Is it something specific in the substance of my posts that you are at odds with, or just in the presentation?
If it's the substance, perhaps you could elaborate and we could further discuss it.
If it's simply the presentation, then I thank you for your opinion and have a nice day.

re: Federal Judge in NY Rules NSA Phone Surveillance Is Legal
Some highlights from the opinion.

quote:

The right to be free from searches and seizures is fundamental, but not absolute. As Justice Jackson famously observed: “the Bill of Rights is not a suicide-pact.” Terminiello v. City of Chicago, 3 3 7 U.S. 1 ( 1949). Whether the Fourth Amendment protects bulk telephony metadata is ultimately a question of reasonableness. Missouri v. McNeely, 133 S. Ct. 1552, 1569-70 (2013) (“[T]he ultimate touchstone of the Fourth Amendment is reasonableness.”). Every day, people voluntarily surrender personal and seemingly-private information to transnational corporations, which exploit that data for profit. Few think twice about it, even though it is far more intrusive than bulk telephony metadata collection.

quote:

There is no evidence that the Government has used any of the bulk telephony metadata it collected for any purpose other than investigating and disrupting terrorist attacks. While there have been unintentional violations of guidelines, those appear to stem from human error and the incredibly complex computer programs that support this vital tool. And once detected, those violations were self-reported and stopped. The bulk telephony metadata collection program is subject to executive and congressional oversight, as well as continual monitoring by a dedicated group of judges who serve on the Foreign Intelligence Surveillance Court.

Nothing will get better. The state will only continue to grow, just at different rates.

Aside: Why is anyone surprised when an arm of the Federal government rules in favor of the government it is part of?

The deck is stacked folks.

Obama wins again.

He needs to reread the 4th Amendment again and why it was written to keep the King Geroges off our backs.
