Story came up on my timeline and wanted to get the PBs thoughts on this.

quote:

It's a showdown that is breaking legal ground -- a local man with no criminal record facing a lifetime behind bars for cutting a rap album.

quote:

Last week, Duncan and some of the 14 other gang members facing attempted murder charges in the case were in court for a preliminary hearing.

quote:

Prosecutors are calling upon a little used statute put in place by voters in 2000. It allows for the prosecution of gang members if they benefit from crimes committed by other gang members.

Though Duncan hasn't been tied to the shootings, prosecutors argued that he benefited from the shootings because his gang gained in status, allowing him to sell more albums.

quote:

"We're not just talking about a CD of anything, of love songs. We're talking about a CD (cover) … there is a revolver with bullets," said Deputy District Attorney Anthony Campagna.

quote:

"It's shocking. He has no criminal record. Nothing in his lyrics say go out and commit a crime. Nothing in his lyrics reference these shootings, yet they are holding him liable for conspiracy. There are huge constitutional issues," said Brian Watkins, Duncan's attorney.

quote:

"Where does that end if that's the definition of criminal liability? Is Martin Scorsese going to be prosecuted if he meets with mafia members for a movie for his next film?" said Kreit. "The Constitution says it can't be a crime to simply make gangster rap songs and hang out with people that are committing crimes. You have to have more involvement than that."

Does this not rub anybody the wrong way, assuming this article is accurate? Please try to put aside your hatred of rap for a second, because someone's lyrics (unless they are implicating themselves in them) should be irrelevant. Kind of sounds like they are trying to put rap music on trial here.

Oh yea, and at a rap name of "Tiny Doo"

This will continue to happen until DAs are persecuted, or at least lose thir law license, for abusing Constitutional rights.

Yea the whole "we're not talking about love songs" thing really made me

Why does the content matter if he doesnt implicate himself?

We're just all making it up as we go along these days. Just because the law's not written down yet doesn't mean Tiny Boo isn't guilty. It's prosecutorial discretion.

It's pure courtroom drama stirred up by ignorant journalists who don't understand that "maximum sentence" is not the same thing as "likely sentence".

That also presumes that the prosecution can prove that Tiny Doo actually conspired to do something illegal.

True, but I think he shouldn't be charged with anything.

According to this article, hes not tied to a homicide but can be charged because he benefited from it in the form of increased CD sales. IF thats true thats BS.

Mr. Doo appears to be a victim of our shitty C/J system and our insatiable desire to blame/prosecute people and ruin their lives.

What a bunch of bullshite. The way we bend laws in this country so the govt can assert power over the citizens is ridiculous. Either prove the guy killed someone or frick off.

If this is all there is too it then it seems pretty weak. Couldn't he be charged with RICO though? I don't think the current charges will stick. Plus with a name like Tiny Doo he would never make it in prison lol. Tiny Doo, come on now. That's like one of the worse rap names I ever heard. Who's gonna buy anything and blast it from their speakers from a guy named tiny doo? I hope he goes by TD or something else.

Never heard of Tiny Doo but this is ridiculous. In fact it's beyond ridiculous. If he played no part in the shootings than leave him alone.

I'm sorry, but I only have room for three black Tiny's. Gallon, Archibald, and Lister. Who should I drop?
