Ah, Liberals...running to the Constitution when it is most convenient

NEW YORK, Jan 28 (Reuters) - A federal appeals court on Monday reinstated a lawsuit brought by a transgendered prisoner against Virginia authorities for refusing to allow her to undergo a sex-change operation.

The 4th U.S. Circuit Court of Appeals found that Ophelia Azriel De'lonta, born Michael Stokes, can argue that denying her the surgery violates the Eighth Amendment's prohibition against cruel and unusual punishment.

In reversing a lower court's decision to dismiss the case for failing to state a cause of action, the 4th Circuit did not order that De'lonta receive the surgery. Instead, it simply found that her lawsuit was viable under the Eighth Amendment and sent the case back down to the district court for further proceedings.

"We do not decide today the merits of De'lonta's claim," Diaz wrote.

Yes, they can argue.

And I don't know about anyone else, but until a person can get rid of all those pesky Y chromosomes, they are still going to be a man - no matter how much they mutilate their genitalia.

You're still a man even if you have silicone pumped into your breast area and have your penis removed. That's why I refer to men or women who get sex change operations as "things".

The panel was made up of 2 Clinton appointees and one Obama appointee.

In looking up that info, I was completely shocked at how many judges on the 4th Circuit were appointed by Democrats. 9 out of 15 active judges were appointed by Dems (10 out of 15 if you want to count the one originally nominated by Bush but renominated by Clinton).

I always thought it was a more conservative court.

Can the prisoner pay for this surgery? No? Too fricking bad. Case dismissed.

But...but....if only the 1%ers paid their fair share there'd be plenty of cash to fund the thing's operation!

Right

It's elective surgery and it's not elective surgery that has any tangible health benefits

I'd rather give a 500 lb prisoner gastic bypass than shite nonsense. At least there might be some tangible health benefit when they get out of prison.

Seems like this person is just trying to use their imprisonment to get free elective surgery

Which is stupid, as sex change surgery isn't something you want to cut corners on, like a government appointed doc would.

Everyone runs to the law when it is convenient, and away when it isn't.

Has nothing to do with whether you are a liberal or not.

Exactly where my thoughts fall on this. It is not a life-saving nor corrective procedure (like repairing a broken bone). The surgery will solve nothing. "It" will still burden the taxpayers with endless hours of therapy for "its" gender confusion.

If "it" wants to pay for the surgery "itself", then who are we to stand in the way of 'progress?'

re: Ah, Liberals...running to the Constitution when it is most convenient
this is such bullshite

when the founders wrote the constitution, they had no way of knowing of transgenders, let alone sexual reassignment surgery

we have evolved beyond the 8th amendment in this instance
