Hypothetical situation -

Say someone comes in contact with a dirty cop, or a cop in a bad mood, etc.. and the cop is looking for any excuse to use his gun, even though no force was necessary, does that person have the right to protect him/herself and expect no repercussions?

Has got to be a slippery situation.

Yeah, the bottom line is that you should never show any kind of physicality with a cop in the first place.

I guess if you were in a fight with civilians and a cop jumped into it, that would be a tough situation tho.

If self preservation is an instinct you possess then comply, no matter how ridiculous the circumstances. You will have your day in court.

Yes, but it would be an uphill battle to prove it.

The juice isn't worth the squeeze on this one. Better to comply and try to burn the guy through the proper channels.

I had a crazy cop try to get me to fight him in my kids school's parking lot. I ran to the office like a little scared kid and hid behind the principal. the principal asked him to leave and he was fired from the force about 3 weeks later.

I'm white, the cop was black.

Don't give him an excuse. Lay down. Hands behind back or head. dont make sudden movements, dont show irritation and paint skin white.

I have played this question out in my head before and it wouldn't be a physical confrontation that would concern me. I can take an arse whipping and handle that later through IA and civil remedies.

The real question of this thread is what to do if the guy engaged you unlawfully with deadly force. That would be the hard one, he starts shooting first and you have to shoot him to survive. Imagine the legal battle getting out of that one... And would it be better if he survived the encounter (i.e. not battling a murder charge but having to counter his testimony) or killing him and having it be just your testimony and the forensic evidence? Now that is a scenario to consider.

Listen friend. Do what I did a few years back. I Immediately went to my knees with my hands up behind my head. I looked down at the crush and run all around my knees on the shoulder of the street. Do not stare into a cops eyes. I could hear the crunch of his boot as he encircled me but I remained calm. Only when the end of his baton under my chin gently signaled that it was okay to look up did I start to feel secure. After he reviewed my papers, I was allowed to leave unharmed and secure in my being.

It is really simple.
